These Terms of Service (“Terms”) govern your access to and use of the online services provided by TheJoSam, including its subsidiaries TheJoSam Development, TheJoSam Engineering, TheJoSam Racing and TheJoSam Gaming (“we”, “us” or “our”).

You are legally obligated to these Terms as well as to any other agreements, terms and rules that we tell you to apply to your use of our Services.

TheJoSam at its sole discretion may modify these Terms at any time. You are responsible for reviewing these Terms each time you use our Services. By using or accessing our services, you agree to comply with and be bound by these Terms.

1 Ability to accept Terms of Service

These Terms of Service form a legally binding contract between you and us. By using our Services, you affirm that you are at least 18 years of age, an emancipated minor or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, representations and responsibilities set forth in these Terms of Service, and to abide by and comply with these Terms of Service.

2 Account and Non-Account users

You do not need an account to access most of our Services. However, if you already have an account on our Services, you will have access to more of the features provided by TheJoSam and its subsidiaries.

Accounts for TheJoSam Services are strictly monitored and go through multiple screening processes before they can access the Services provided by us. Only pre-approved users may register accounts or use restricted features.

You must be at least 16 years of age to register or interact with any non-public or restricted features, in accordance with the General Data Protection Regulation (GDPR) and German Federal Data Protection Act (BDSG). We will preserve the right to validate your account with any Government ID if needed.

For unrestricted features (e.g. public polls or guest forms), use by those under 16 must be with legal parental or guardian consent.

Any unauthorized or underage registration is strictly prohibited.

3 User Accounts and Conduct

3.1 Warranty Disclaimer

Your use of our Services is at your sole risk. To the fullest extent permitted by law, TheJoSam, tis officers, directors, shareholders, employees, representatives and agents disclaim all warranties, express or implied, including the implied warranties and conditions of merchantability, fitness for a particular purpose and non-infringement, in connection with our Services and your use of them. TheJoSam makes no warranties or representations about the accuracy, completeness or operation of our Services. TheJoSam does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third-party through our Sites, for any third-party advertisements, promotions, product placements, or marketing materials, or for any hyperlinked website or feature in any banner or other advertising. TheJoSam will not be a party to or in any way responsible for monitoring any transaction between you and third-party providers of products or services.

3.2 Security

Your Data will be protected on our side by all means possible, this includes and is not limited to Database security, secure procedures and zero-knowledge procedures for your Security Information.
Login Security will be managed by yourself and any security compromise from not our side or “higher-means” is recognized as your own damage. This excludes us from any liability caused by unsecure standards from your side and you need to secure your account on your own.

3.3 Conduct

You are responsible for your account and agree to (a) provide accurate and current information, (b) keep your credentials secure, (c) not impersonate other persons for you own gains, (d) not misuse or abuse any of the services provided by TheJoSam or its subsidiaries.

We reserve the right to restrict, suspend, or terminate accounts in the event of abuse or violation of these Terms, also additional screening of your account can be requested with reasonable suspicion of violation of 3.3a, 3.3c or 3.3d.

4 Legal Ownership of content

4.1 Content created by TheJoSam

The Services, Parts, Equipment, Software and Hardware (“Product”) created by TheJoSam and its subsidiaries is protected under the Digital Millennium Copyright Act (17 U.S.C. 512 et seq.) and EU equivalent therefore if not specifically allowed the Product is to be used only for NON-Commercial use and without sharing or modifying the Product itself. Copyright Infringement will prosecute if needed.

All content, branding, and materials under TheJoSam and its subsidiaries are protected by intellectual property laws. Users may not copy, modify, distribute, or reverse-engineer any part of the platform or services without express permission.

4.2 Content created by other users

Just as TheJoSam requires users of our Sites to respect our copyrights and those of our affiliates, licensors and business partners, we respect the copyrights of others. To that end, we have adopted a copyright policy in accordance with the Digital Millennium Copyright Act (17 U.S.C. 512 et seq.). If you believe in good faith that your copyrighted work has been reproduced on our Sites without authorization in a way that constitutes copyright infringement, or if you are the provider of content and believe a copyright infringement notice has been wrongly submitted against you as a result of mistake or a misidentification of the claimed copyrighted material, you may consult with our Administration Team.

5 Services provided by TheJoSam

TheJoSam and its subsidiaries provide many to its division tailored services and are not limited to:

·         Cloud-based File Storage and Sharing for pre-approved users

·         Public file downloads

·         Online Forms

·         Polls

·         Appointment Planning

·         Media creation and modification

Under these Services we also provide Services by our subsidiaries listed under Section 10.
The Services listed here and in Section 10 are governed in this Terms of Service document.

6 File Uploads, Sharing and Downloads

Use of our File Management services at your own risk.

6.1 File Uploads

As approved User you will be grant access to our Cloud Storage that is and not limited to File Uploads. All users are individually responsible for the legality and appropriateness of the content they upload or distribute. TheJoSam and its subsidiaries will remove any files found to be in violation of these Terms or applicable laws, without notice and will report any inappropriate content if required.

You retain rights to your uploaded content but grand us a non-exclusive, revocable license to store and, where applicable, make it publicly accessible.

You may not upload or distribute (a) illegal content (e.g. child exploitation, extremist content), (b) copyright-infringing works without permission, (c) Malware, phishing, or harmful software, (d) Personal Data of third parties without consent, or (e) Content promoting hate speech, violence, or harassment. Violation may result in immediate account termination and notification of authorities.

6.2 File Management and Sharing

Sharing of Files is only permitted for approved users and any misconduct or abuse of these Service will result in account suspension or termination.

6.3 File Downloads

TheJoSam does not in any shape or form validate the security or trustworthiness of the data downloaded. Downloading from our services is protected by our Data Security Policy and does not require a pre-approved account to do so. Misuse of the fully public access to “public shares” will result in IP-blacklisting and if required additional prosecution by law.

7 Data Protection & Privacy

TheJoSam and its subsidiaries are fully compliant with the GDPR and German data privacy laws (BDSG). (a) We only process personal data necessary to deliver services, (b) we operate under strict non-disclosure policy, except when disclosure is required by law (e.g. for illegal material).

8 Monetization & Payment

Some features are subject to requiring payment for operation or access to the full feature set these include one-time purchases, recurring subscriptions and free or trail-based access.

No third-party advertisements are used. Promotional content may reference TheJoSam or its subsidiaries only. All purchases are subject to our payment and refund policies, disclosed at the point of sale.

EX1 Termination and Account Deletion

We reserve the right to (a) terminate any account for breach of these Terms, (b) remove any files, posts, or shared content in violation of legal or ethical standards, (c) respond to violations with permanent suspension, bans, content deletion, or legal action.

You may request full account and data deletion at any time.

EX2 Disclaimer and Limitation of Liability

Services are provided “as is” without warranty of any kind. TheJoSam and its subsidiaries are not liable for (a) data loss, corruption, or unauthorized access to files, (b) downtime or service interruption, (c) damages resulting from user content or external misuse.

Use of our Services is at your own discretion and risk.

9 Governing Law

These Terms are governed by the laws of the European Union and the Federal Republic of Germany. All disputes shall be subject to the jurisdiction of the courts of Germany, unless mandatory EU consumer protection law provides otherwise.

10 Subsidiary-Specific Terms

10.1 TheJoSam Development

TheJoSam Development serves as a core division within TheJoSam, specializing in both software and electronics development. It provides services not only to individual clients but also to internal departments and subsidiaries.

10.1.1 Services Provided by TheJoSam Development

·         Software development, engineering, and deployment

·         Electronics diagnostics, repair, and integration

·         Prototyping and 3D printing

·         Data analytics and automation solutions

TheJoSam Development provides different tailor-made and off-the-shelf solutions with custom Terms on point-of-sale.

10.1.2 Eligibility and Audience

Access to the provided Services is regulated by the TheJoSam Administration and the services are intended for Clients, professionals, businesses in need of specialized digital solutions. This requires Invoicing, billing, and other contracts to be formed, this requires users to be 18 years of age or older, or 16 years and older with written consent from a parent or legal guardian.

10.1.3 Data Privacy and Confidentiality

TheJoSam Development handles data processing and data storage for TheJoSam and its subsidiaries for this TheJoSam Development enforces advanced data privacy standards, including zero-knowledge handling where requested. Our Data Privacy and Security standards are fully compliant with the General Data Protection Regulation (GDPR) and German Data Privacy Regulation (BDSG). Data handled by TheJoSam is never accessed, stored long-term, or shared without legal obligation or explicit consent, the TheJoSam Administration reserves the right to delete any data and suspend any account with reasonable suspicion.

10.1.4 Custom Project Terms

Projects tailored to individual client needs are processed with custom terms included on point-of-sale, billing structures may vary standard TheJoSam billing and are established per project agreement (e.g. hourly, fixed, subscription). TheJoSam Development reserves the right to decline unethical or illegal service requests.

10.2 TheJoSam Engineering

TheJoSam Engineering functions as both a core division, supporting all TheJoSam brands and services. It designs, develops, and optimizes hardware for direct clients as well as for internal use across the company.

10.2.1 Services Provided by TheJoSam Engineering

·         3D printing and prototyping

·         Hardware engineering and design

·         Component simulation and optimization

·         Seamless hardware-software deployment in collaboration with TheJoSam Development

TheJoSam Engineering provides a similar Service catalogue as TheJoSam Development. Services can be removed, suspended or outright refused at any time.

10.2.2 Eligibility and Audience

Access to the provided Services is regulated by the TheJoSam Administration and the services are intended for Clients, professionals, businesses in need of specialized hardware solutions. Invoicing, billing, and other contracts are to be formed, this requires users to be 18 years of age or older, or 16 years and older with written consent from a parent or legal guardian.

10.2.3 Custom Project Terms

Projects tailored to individual client needs are processed with custom terms included on point-of-sale, billing structures may vary standard TheJoSam billing and are established per project agreement (e.g. hourly, fixed, subscription). TheJoSam Development reserves the right to decline unethical or illegal service requests. Project can be use-case-specific and custom-built as such no warranty is given outside the Law requirements. Clients are responsible for the lawful and compliant use of any delivered hardware. TheJoSam Engineering does not cover liability to live or death. Compatibility with third-party software or hardware is not guaranteed unless explicitly documented.

10.3 TheJoSam Racing

TheJoSam Racing specializes in engineering and development for radio-controlled vehicles, motorcycles, mountain bikes, sim-racing equipment, and various racing hardware and software solutions.

10.3.1 Services Provided by TheJoSam Racing

·         Part engineering

·         Software engineering

·         Electronics integration

·         Custom part design

·         3d printing and prototyping

·         Part modification

·         Media creation and modification

TheJoSam Racing employs Services provided by TheJoSam Development and TheJoSam Engineering paired with the expertise of TheJoSam Racing. Services provided by TheJoSam Racing form a contract with these additional subsidiaries.

10.3.2 Eligibility and Audience

TheJoSam Racing services are intended for users with 16 years of age and older, billing requires an individual to form a contract as such billing is only allowed to persons with 18 years of age, or legal guardianship written approvals. Multi-Project based approvals allowed.

The Audience for Services provided by us are enthusiasts in their respective field and hobby/amateur/professional racing drivers.

10.3.3 Client-Customized Services

Services provided allow for Client specific modifications with various billing and Project structures. TheJoSam Racing does not allow for modification and customization of all-in-one solutions, custom kits can be assembled if needed. Clients are responsible for requirement and specification description parts produced to spec are “as is” and cannot be refunded, and we are not liable for miscommunication or misapplication outside of signed specs. TheJoSam Racing reserves the right to refuse any liability if the product is applied incorrect or outside its intended use.

10.3.4 Safety and Liability:

Modifications done to existing third-party products are at client’s own risk, users are responsible for ensuring compliance with local vehicle or racing regulations, TheJoSam Racing does not pre-check their products for vehicle code, material or manufacturing certificates can be requested, product is “as is” only for its intended use. Vehicles modified or custom equipment is not checked for regulatory compliance.

10.4 TheJoSam Gaming

TheJoSam Gaming specializes in delivering gaming-related services and is an integral part of the TheJoSam Server-Hosting ecosystem.

10.4.1 Services provided by TheJoSam Gaming

·         Game server hosting for various games

·         In-game item creation, equipment, and development services

·         Game modification

·         Tool development

·         Hardware engineering and modification

Services provided by TheJoSam Gaming may be billed from TheJoSam Development as its parent company.

10.4.2 Eligibility and Audience

Services provided by TheJoSam Gaming targets the audience of Game requested. Billing requires legal forming of a contract.

Server-Hosting may only be available to users 18 years of age and older, or 16 years old with written adult consent (game age restrictions may require additional approval).

10.4.3 Administration and Data Handling

Server hosting is administered by TheJoSam Development, ensuring compliance with all relevant data privacy and security laws and standards. User data is processed within complies fully with GDPR and German data privacy regulations (BDSG). TheJoSam Gaming reserves the right to publish any not private information for Media and Security purposes, additional can be viewed in our privacy policy.

10.4.4 User Responsibility and Liability

Users are responsible for their conduct on game servers, including adherence to game and community guidelines. TheJoSam Gaming disclaims liability for in-game transactions or interactions beyond service provision; we reserve the right to shutdown any misused Services on report.
